It has come to the Board's attention that there are malicious lies and rumours being posted about Dorchester Town FC and HM Revenues and Customs.
The Truth.
All current payments of PAYE (Income Tax) and VAT have been made IN FULL. The current year is uptodate.
When Shaun Hearn acquired the 51% majority share holding from Eddie Mitchell they agreed a list of creditors (money the club owed) and a list of debtors (money owed to the club). Shaun then took on the agreed creditors and debtors.
Included in the creditors was an amount of money owed to HM Revenue and Customs. An instament schedule was agreed with H M Revenues and Customs to pay this over a period of time. This is common practice amongst football clubs and businesses in general. Indeed about one third of all conference clubs have such an arrangement in place.
During January/February 2010 there was prelonged period of bad weather and we lost matches. This affected cashflow and we missed an instalment.
The club is continuing to make the instalment payments and talking to H M Revenue and Customs about the missed payment.
The club is in a much healthier position than it was a year ago and the the board has substantially reduced the amount of money it owes at the same time as providing Ashley Vickers with a competitive wages budget for the forthcoming season.

The request for a winding up petition does not trigger any sanction against clubs. If an order is granted then it triggers the rules on insolvency which are severe.
However, as Shaun said in the paper it should be sorted this week

The link below is worth reading.It is from Hydes forum .In this thread it makes mention of Hinckley they ,it would appear are subect to a transfer embargo due to them being in arrears with HMRC.The posting claims that even though they are paying their tax debt in insatlments and in line with an agreement between the club and HMRC they cannot sign players.
I must admit I thought the ruling was that a club is allowed to be in debt with HMRC but an embargo would not be enforced if the arrears were being paid in line with an agreement between the club and HMRC .Its difficult to see if HMRC have issued a winding up order how an agreement could be in place.
The real difficult thing is that unlike a lot of leagues you cant seeon line up to date regulations of the conference so it would not suprise me if this rule is no longer in the league rule book. _________________ Come on U Terras

The above is correct. If an arrangement is in place with R & C no embargo is imposed.
Do other leagues have their full rules and regulations online? If they do i can raise it at Conference board meeting

What is really quite of a worry is that once you start to dig you can find out all sorts of things that really start to open your eyes a lot of things often are not quite what others would have you believe. _________________ Come on U Terras

As I said on here a few months ago quite a few things that I have llearnt I wish I hadnt
What really is sad is the OHEC are a way behind with the news and even when they do report the lack of depth in their stories is really quite a disgrace.
For instance the fact that DTFC were issued with a winding up notice was published in the London Gazette on 20/4/2010 yet it took over two months for this fact to be published in the OHEC

I have no real major understanding of the rules regarding this and to be honest no real desire to learn them either. The club has David Martin for that and he does a good job. DORCHESTER Town have avoided an appearance in court tomorrow after reaching an agreement with HM Revenue & Customs (HMRC) over an unpaid tax bill.
The Magpies were issued with a winding up petition last month having defaulted on one instalment of an arranged payment plan with HMRC – over an inherited tax debt from the previous regime.
The case was due to be heard tomorrow at the Royal Courts of Justice but the county town club have received a three-month stay of execution.
Vice-chairman and club secretary David Martin explained: “The club and Revenue & Customs have agreed details for a validation order and this means that the petition will be deferred for a period of up to three months.
“During that period there will be an instalment plan to pay the small amount of arrears owing.
“If the club make the payments on the agreed dates then the petition will be dismissed at the end of the three-month period.
“One of the requirements of the court and Revenue & Customs was that we provided a cash flow forecast to show we could meet the terms of the agreement, which we have done.
“Around one third of Conference clubs have arrangements in place with Revenue & Customs so it’s not unusual.
“Hopefully this news will help put people’s minds at rest while we can get on with running the football club.”
